Welcome to Shantanjo Technologies Private Limited ("Shantanjo Technologies," "Shantanjo," "we," "our," or "us").
These Terms of Service ("Terms") govern your access to and use of our website, https://www.shantanjo.com, including its content, contact forms, service inquiry forms, IT assessment requests, and other website features.
Shantanjo Technologies provides technology and IT services, which may include managed IT services, cloud management, cybersecurity, Microsoft 365 administration, Google Workspace services, cloud migrations, IT consulting, and technology automation.
By accessing or using our website, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please discontinue your use of the website.
These Terms govern website use. Specific services provided to customers may be subject to separate written agreements, service contracts, statements of work, service-level agreements, and other applicable terms.
2. Eligibility and Business Use
Our website is intended primarily for businesses, professionals, and individuals seeking information about our technology services.
By using our website or submitting an inquiry, you confirm that the information you provide is accurate to the best of your knowledge and that you are legally permitted to use the website.
If you submit an inquiry on behalf of an organization, you represent that you are authorized to provide the submitted information for that purpose.
3. Website Information and Service Descriptions
We make reasonable efforts to ensure that the information published on our website is accurate and current. However, website content is provided for general informational purposes and may be updated, modified, or removed without prior notice.
Descriptions of our services, technologies, capabilities, and solutions are intended to provide an overview of what we offer. The precise services, deliverables, timelines, pricing, and responsibilities applicable to a particular engagement will be established in the relevant written agreement.
The appearance of a technology, product, platform, or service on our website does not necessarily mean that we are affiliated with, certified by, or endorsed by its owner.
Third-party names and trademarks belong to their respective owners.
4. Contact Forms and Service Requests
Our website may allow you to submit contact inquiries, request an IT assessment, or express interest in our services.
Submitting a form does not:
- Create a customer relationship or service contract.
- Guarantee that we will accept or undertake the requested engagement.
- Guarantee that an assessment, consultation, or service will be provided free of charge unless expressly confirmed by us.
- Establish a confirmed appointment unless an appointment is separately scheduled or confirmed.
- Constitute acceptance of a quotation, proposal, or commercial offer.
We may contact you using the information you provide to respond to your inquiry, request additional information, discuss your requirements, or explain relevant services.
Please do not submit passwords, authentication codes, payment card details, confidential system credentials, or sensitive business data through public website forms.
5. Free IT Assessments and Consultations
If we offer a free IT assessment, consultation, or introductory review, the scope and availability of that offer may be limited.
Unless otherwise agreed in writing:
- A free assessment is an initial review intended to identify potential areas for improvement.
- It is not necessarily a comprehensive security audit, penetration test, compliance assessment, forensic investigation, or certification.
- Findings may be based on limited information and the access made available during the assessment.
- We do not guarantee that an assessment will identify every vulnerability, configuration issue, compliance gap, or operational risk.
- Remediation work, implementation, detailed reports, ongoing support, and additional consulting may require a separate paid engagement.
- Any specific deliverables, exclusions, time limits, and fees will be communicated as appropriate for the offer.
6. Service Engagements and Commercial Terms
Services purchased from Shantanjo Technologies will be governed by the applicable proposal, quotation, statement of work, master services agreement, service-level agreement, or other written contract.
Depending on the engagement, those documents may specify:
- Service scope, deliverables, and exclusions.
- Customer and provider responsibilities.
- Fees, payment schedules, taxes, and applicable expenses.
- Project timelines, dependencies, and acceptance criteria.
- Support hours, response targets, and escalation procedures.
- Confidentiality, data protection, and security obligations.
- Intellectual property ownership and licensing.
- Suspension, termination, and transition arrangements.
A separate written service agreement will take precedence over these website Terms to the extent of any direct conflict concerning the contracted services, subject to applicable law.
We reserve the right to decline an inquiry or proposed engagement where appropriate.
7. Customer Responsibilities
When engaging our services, customers may be required to:
- Provide accurate information about their IT environment and business requirements.
- Maintain appropriate licenses, subscriptions, permissions, and authorizations.
- Obtain necessary internal approvals and third-party permissions.
- Provide timely access to systems, personnel, documentation, and relevant environments.
- Maintain appropriate backups and disaster recovery arrangements as agreed for the engagement.
- Inform us of applicable security policies, regulatory obligations, and operational constraints.
- Cooperate with reasonable requests necessary to deliver the agreed services.
Customers remain responsible for their business decisions, their users' conduct, their legal and regulatory obligations, and any responsibilities expressly assigned to them under a service agreement.
8. Cybersecurity and Technology Limitations
Cybersecurity and IT management involve risks that cannot be completely eliminated.
Although we may implement reasonable and agreed security measures, no technology, security control, cloud platform, or IT environment can be guaranteed to be entirely secure or continuously available.
Unless expressly agreed in a written contract, we do not guarantee:
- Complete prevention of cyberattacks, malware, phishing, unauthorized access, or data loss.
- Uninterrupted operation of third-party platforms or internet services.
- Detection of every security vulnerability or threat.
- Continuous availability of systems beyond the applicable service commitments.
- Compliance with every legal, regulatory, or industry requirement applicable to a customer's business.
Customers should maintain appropriate backups, access controls, incident response procedures, and recovery arrangements consistent with their operational needs and contractual responsibilities.
Nothing in this section excludes a responsibility or liability that cannot lawfully be excluded.
9. Third-Party Platforms and Services
Our services and website may reference, integrate with, or depend on third-party products and platforms, including Microsoft 365, Microsoft Azure, AWS, Google Workspace, Wix, and other SaaS or cloud services.
The availability, functionality, licensing, pricing, and terms of those third-party services are controlled by their respective providers.
Your use of third-party products may be subject to separate license agreements, terms of service, and privacy policies.
Unless expressly agreed in writing, Shantanjo Technologies does not control third-party service availability, provider policy changes, product discontinuation, or failures originating outside our agreed scope of responsibility.
We will address third-party dependencies in accordance with the terms of the applicable service engagement.
10. Acceptable Use
You agree not to use our website to:
- Violate applicable laws or regulations.
- Attempt unauthorized access to our website, systems, accounts, or infrastructure.
- Introduce malware or other harmful code.
- Interfere with the website's availability, security, or operation.
- Submit fraudulent, misleading, or malicious inquiries.
- Impersonate another person or misrepresent your authority.
- Scrape, copy, or collect website information through unauthorized or abusive means.
- Infringe intellectual property, privacy, or other legal rights.
- Use our website to facilitate unlawful or harmful activities.
We may restrict or suspend access where reasonably necessary to protect our website, systems, users, or legal interests.
11. Intellectual Property
Unless otherwise indicated, the content of our website, including text, graphics, logos, visual designs, and original materials, is owned by or licensed to Shantanjo Technologies and is protected by applicable intellectual property laws.
You may access and use website content for personal or internal business informational purposes.
You must not reproduce, republish, distribute, modify, commercially exploit, or create derivative works from our website content without prior authorization, except where permitted by applicable law.
The intellectual property rights relating to deliverables, scripts, configurations, documentation, software, and other work produced during a customer engagement will be determined by the applicable written agreement.
Nothing in these Terms transfers ownership of a customer's existing intellectual property or grants rights to third-party intellectual property beyond applicable permissions.
12. Confidentiality and Personal Information
Information submitted through our public website forms is handled in accordance with our Privacy Policy.
Submitting information through a website form does not automatically establish a contractual confidentiality obligation.
If you need to share confidential technical information, security documentation, customer data, or other sensitive material, please contact us to arrange an appropriate secure communication method.
Confidentiality obligations arising from an actual service engagement will be governed by the applicable written agreement.
13. Website Availability and Disclaimer
We aim to keep our website accessible and functional, but we do not guarantee uninterrupted availability, error-free operation, or compatibility with every device or browser.
To the extent permitted by applicable law, the website and its content are provided on an "as is" and "as available" basis.
We disclaim warranties concerning the website to the extent permitted by law, including implied warranties that cannot lawfully be excluded.
This section does not override any express warranty or service commitment made under a separate written customer agreement.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Shantanjo Technologies will not be liable for indirect, incidental, special, exemplary, or consequential losses arising solely from your access to or use of the website, including loss of profits, business opportunities, or data, where such exclusions are legally permitted.
We are not responsible for losses caused by factors outside our reasonable control, including third-party website outages or internet disruptions, subject to applicable law.
These website Terms do not establish a blanket liability limit for separately contracted IT services. Liability for a customer engagement will be governed by the applicable written agreement and applicable law.
Nothing in these Terms excludes or restricts liability that cannot legally be excluded or restricted, including any mandatory consumer rights or other non-waivable protections.
15. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, and reasonable costs arising from your unlawful use of the website, your material violation of these Terms, or your infringement of another party's rights.
This provision does not apply to the extent a claim results from our own acts or omissions for which we are legally responsible, and it does not override any applicable statutory protections.
16. Suspension and Termination
We may restrict access to our website where reasonably necessary to address security concerns, misuse, unlawful activity, technical problems, or other legitimate operational requirements.
You may stop using the website at any time.
Termination of access to the website does not automatically terminate an existing service engagement. The termination of contracted services will be governed by the applicable written agreement.
17. Changes to These Terms
We may update these Terms periodically to reflect changes in our website, business operations, services, or applicable legal requirements.
Updated Terms will be published on this page with a revised "Last Updated" date.
Changes will apply from the effective date indicated in the updated Terms, subject to applicable law and any notice requirements that apply.
We encourage you to review this page periodically.
18. Governing Law and Dispute Resolution
These Terms are subject to the laws of India, except where mandatory applicable law requires otherwise.
Subject to applicable law and any separate written agreement, disputes relating to these website Terms will be submitted to the competent courts having jurisdiction in Mumbai, Maharashtra, India, provided those courts have jurisdiction over the dispute.
